The Tamaki Drive Mystery: Where is the Justice?

A 65-year-old cyclist, eight cops, and a missing court date.

Back on the 5th of November last year (2025), a bit of a scene kicked off on Auckland’s Tamaki Drive. Reports started coming in about a 65-year-old pensioner enjoying a naked ride along that iconic 9.6km stretch of coast. Before long, four police cars and eight officers were on the scene to "apprehend" one man on a bike.

He was arrested for offensive behaviour, and while the NZ Herald reported on the arrest at the time, things have gone dead quiet ever since.


The Missing Record

We’ve been keeping a close eye on this one, but to date there’s no public record of a court appearance, a sentence, or even the man's name. It’s like the case has just vanished into thin air.


The Naked Truth officially challenged this silence via an Official Information Act (OIA) request to the NZ Police. We wanted to know if the case had been heard and what the outcome was. The response we got back was telling. The Police refused to disclose the file, stating that doing so "may be a detriment to the Prosecution Case which has yet to be fully finalised."


Six months on, and the case still isn't "finalised"? That "hard graft" by the Police suggests they know they’re on shaky legal ground. There are a few reasons why this might be dragging out:

  • The Lowe Dead-End: The Police may be realizing that, thanks to the 2010 Lowe Precedent, a conviction is unlikely, and they are looking for a way to let the case go without losing face.

  • Diversion in Progress: He may be currently completing conditions for Police Diversion. Until those are finished, the case technically isn't "finalised."

  • Suppression & The Gap: The court may have suppressed the details, or it’s simply buried in the District Court system where minor matters often stay out of the public eye.


Regardless of the delay, the fact that the Police are still "finalising" a case about a man on a bike tells you everything you need to know about how "offensive" he actually was.


Why We Care: The Lowe Precedent

The "Naked Truth" is that this man should have had a rock-solid defence. Back in 2010, the High Court dealt with a nearly identical case (Lowe v Police). In that one, the judge quashed a conviction for a naked cyclist, ruling that just being nude isn’t enough to be "offensive" under the law — especially if you aren't being a nuisance.


We reckon this 65-year-old was just following in those same tyre tracks. Whether he got off through a lawyer or a bit of common sense from the police, we may never know for sure — but we aren't going to let this one slide. The fact that the Police are still "finalising" a case about a 65-year-old on a bike — six months after the fact — suggests a legal system that’s unsure of its own footing.


The Naked Truth will continue to monitor the courts and push for answers. If this case eventually makes it to a hearing or if the Police finally "flick the switch" and drop it, you’ll hear it here first. We have the right to seek a review by the Ombudsman regarding the OIA blockade, and we aren't afraid to use it.
