New Plymouth anti nudity bylaw.

Has this been challenged. This sounds like northshore city antics which were anulled years ago. Based on the Bill of Rights Act this bylaw is null and void. This type of small town legislation creepage is what has happened in the USA and local politics take over from the bottom up. How can a council develop legislation that contradicts common law and or statute.

Any comments

Hi Rokker, upon further research it seems there was a succesful prosecution and conviction. The individual is banned from all beaches in New Plymouth.

There was some lewdness in his actions when engaging the group so desevedly so. It only takes one person. to ruin our good reputation and public relations efforts.

This event happend 2022. The bylaw was introduced 2008 and reconfirmed in 2014.

The overall effect I suspect will reinforce their " council " need for the original bylaw despite its ambiguous and uninforcable nature.

Thank goodness for the legal precedent that has been developed over recent years.

It would be great if the Bylaw was worded differnetly and addressed " lewd behaviour " and not simple nudity which is the implication. Good luck in getting it revised at this stage. Hopefully it dosnt spread to other cities/townships.Understand there have been a handful of cases of public nudity in recent years that had succcessful outcomes.

Love the website... well designed. Keep up your good work.
